1.- PARTIES AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF CONTRACT (hereinafter, General Conditions or GTC)
On the one hand, the ticket provider, Cabildo de Gran Canaria (hereinafter, the provider), with registered office at C/ Bravo Murillo, 23 (postcode 35003, Las Palmas de Gran Canaria), Tax ID (CIF) P3500001G, customer service telephone +34 928 21 92 29 and email [CUSTOMER SERVICE EMAIL], sets out the contractual document that shall govern the contracting of tickets through this website.
And on the other hand, the User-Customer (hereinafter, the User), registered on the Yesweticket platform by means of a username and password, over which they have full responsibility of use and custody, being responsible for the truthfulness of the personal data provided to the provider.
BOTH ACCEPT this document, which entails that the user:
- Has read, understands and comprehends what is set out herein.
- That they are a person of legal age and with sufficient capacity to contract.
- That they assume all the obligations set out herein.
- That they have read and accept these general conditions of purchase from the moment they acquire any ticket offered.
This document may be printed and stored by the Users.
The provider makes the email address [CUSTOMER SERVICE EMAIL] available to them so that they may raise any query about these conditions.
These conditions shall have an indefinite period of validity and shall be applicable to all contracts made through: https://cuevapintada.yesweticket.es
The provider reserves the right to unilaterally modify these General Conditions, without this affecting what was acquired prior to the modification, for the purpose of improving the services offered. In any case, before purchasing the tickets you must consult these general conditions.
The Cabildo de Gran Canaria is not responsible for the consequences that may result from improper use of the tickets on sale on the website.
The user waives any claim of liability against the Cabildo de Gran Canaria on any grounds in any case of dissatisfaction with the services purchased on this website, as well as for possible failures, slowness of access or errors in accessing the website, including loss of data or other types of information that may exist on the computer or network of the user accessing it.
The Cabildo de Gran Canaria makes available, through https://cuevapintada.yesweticket.es, the sale of tickets to the events organised by it.
2.- PURPOSE OF THE CONTRACT
2.1.- Scope of application: The purpose of this contract is to regulate the contractual sales relationship arising between the provider and the user at the moment the latter accepts these purchase conditions during the online contracting process by checking the corresponding box. These GTC shall apply from the day on which the purchase is made. The contractual sales relationship entails the delivery, in exchange for a price determined and publicly displayed through the website, of a specific service.
2.2.- Territory of application: The purchase of tickets is active for the whole world.
2.3.- Capacity to contract: To place an order you must be of legal age and have the capacity to contract.
2.4.- Customer acceptance: The validation of the purchase through the website is carried out by email and implies the automatic acceptance of the GTC. These conditions are available on the website or, if you wish and request it, we can make them available to you by email.
2.5.- Modification of the General Terms and Conditions of Contract: the Cabildo de Gran Canaria reserves the right to make changes and/or modifications to these GTC. We advise users to review them regularly. Should such changes or modifications be introduced once the order has been placed, the conditions in force on the date on which that purchase was made shall apply.
3.- INFORMATION PROVIDED ON THE WEBSITE
3.1.- Publication of prices: The prices of the tickets are those shown on each of them on the website.
3.2.- Ticket sale information: The information appearing in our advertising, brochures, other written material, on our website or that which we have provided to you, constitutes an invitation to make a purchase. The contents are constantly renewed and updated to offer users the most complete and detailed information possible. All contractual information included on the website is displayed in Spanish and/or the other languages available on the website.
3.3.- Ticket availability: There may be occasions when tickets are sold out. In that case, the event will be visible but not available for purchasing tickets. Each event identifies the number of tickets remaining available.
3.4.- Orders 24h, every day of the year: Purchase management hours are twenty-four (24) hours, three hundred and sixty-five (365) days a year. Customer service hours are detailed in the contact section of the website.
3.5.- Fraud: If the Cabildo de Gran Canaria suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.
4.- PURCHASE PROCEDURE
The user, in order to access the purchase of the tickets made available by the provider, must register through the website by creating a user account. To do so, the user must freely and voluntarily provide the personal data required of them.
The user shall select a username and password, undertaking to make diligent use of them and not to make them available to third parties, as well as to notify the provider of their loss or theft or of possible access by an unauthorised third party, so that the provider may proceed with immediate blocking.
The user may not choose as a username words whose purpose is to mislead others into identifying them as a member of the provider, as well as offensive, insulting expressions and, in general, those contrary to the law or to the requirements of morality and good customs.
Please be informed that, in accordance with the requirements of art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure shall follow these steps:
- Once the ticket/s are chosen by clicking on them and selecting the number, they will be added to the shopping basket. You will need to click on the finalise tab to place the order. Upon clicking this option, you will move to the next step.
- The user's email will be requested and, depending on whether they are already registered or not, the process will proceed in one way or another:
- User registration: if you are not a previously registered user, in order to make the purchase (such registration is free), you will need to complete a data collection form (in which you will have to accept the Privacy Policy). Once done, you will be able to access the confirmation and payment (in the case of non-free tickets) of the tickets.
- If you were already registered and a customer, you must enter your password to proceed with the confirmation and payment (in the case of non-free tickets) of the tickets.
- Once identified, a check box will appear that you must tick, as it is the acceptance of these General Contracting Clauses and the Privacy Policy.
- To complete the procedure, you must click the Finalise button.
You must check the spam and junk mail controls of your email inbox and always verify that the contact details you provide are correct.
In any case, the contracting platform will send the user, once the contracting procedure is completed, an email with all the characteristics and the tickets.
Should there be any kind of error in the address indicated or at any other point of the order, you must notify it immediately to the email address that will appear on the website in order to proceed with the correction of that error.

The Cabildo de Gran Canaria will provide Customer Service FREE OF CHARGE through our contact email [CUSTOMER SERVICE EMAIL]; if you choose another alternative means of communication, it is the user who must bear the particular cost of it.
The Cabildo de Gran Canaria makes telephones in Spain available to you, subject to the cost of your telephone operator.
5.- TICKETS AND ACCESS
Once the purchase is completed and payment received, the Cabildo de Gran Canaria will send you a confirmation email, to which the purchased ticket/s will be attached.
It is the user's responsibility to check that the ticket details are correct.
The number of tickets that each user purchases is limited.
To access the venue, you must show the ticket in physical format or on your mobile. Should it be necessary to deliver it in a single way, the user will be informed in the confirmation email. In cases where it is necessary to deliver it physically, the Cabildo de Gran Canaria is not responsible for its loss or theft.
Each event will have venue access conditions:
- Access to or remaining in the venue will be prohibited for those persons who display violent or inappropriate behaviour.
- Access with objects that the organisation considers dangerous or harmful will not be permitted.
- Access with drink and food is not permitted, with the exception of water.
- Access with animals will not be permitted, except with guide dogs.
- Do not attend with professional recording, photographic or video material (tripods, lenses, etc.).
- There may be particular conditions that will be stipulated on the website and which the user may consult.
Minors
Minors under 16 years of age may not access the venue without the company of the parent/legal guardian or authorised adult. Said companion will be responsible for any conduct or action contrary to the conditions set out herein that the minor may carry out. The sale of alcohol to minors under 18 years of age is prohibited.
6.- PRICES AND VALIDITY PERIODS OF THE OFFERS
All prices displayed on the tickets include the VAT in force at the time of purchase. All prices shown on the website are valid and shall be expressed in the Euro currency (€).
The user will receive the invoice for the order at the email address provided by the user once the purchase has been made.
In the case of limited-duration promotions, the promotion discount shall apply provided that the order has been registered during the promotion period.
The data recorded by the different payment methods constitute proof of the date on which the financial transactions were carried out and shall serve to determine whether or not said purchase is subject to a promotion.
7.- METHODS OF PAYMENT
Payment by credit or debit card: The user must have a valid credit or debit card, on which they must specify all the digits of the card number in the corresponding form. The transaction will be formalised at the moment of placing the order. Only payments with secure cards are accepted, in which the authentication of your identity as cardholder is carried out according to the method established by your bank, through secure electronic commerce ("Verified by Visa" and "MasterCard SecureCode"). The order cannot be taken into account and will not be processed until the payment has been authorised by your bank.
The system known as SSL (Secure Sockets Layer) is used, a payment system in a secure environment, since it allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.
8.- CANCELLATION / CHANGES
Cancellation
Once the user has purchased the tickets, these can only be returned if:
- For reasons not attributable to the event, it does not take place; the amount of the purchased ticket/s will be refunded, in accordance with the provisions of article 46.2 of the Consolidated Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of 5 March.
- Due to a change of date. In this case, a new date and equal seating and admission conditions will be offered. If this new date does not suit the user, the amount of the purchased ticket/s will be refunded. The user will receive an email with the management process and deadline to request the refund. If, once the deadline has passed, no response has been received, the money will not be returned.
- Users who do not attend the event are not entitled to a refund of the amount of the purchased ticket/s.
For the refund, you will receive an email indicating in each case the procedure to follow.
9.- REFUNDS
When the return occurs, the amount paid will be refunded. The deadline to make the refund will be at most within 14 calendar days from when the return was accepted, and through the same means in which the purchase was made.
10.- NULLITY AND INEFFECTIVENESS OF THE CLAUSES
If any clause included in these General Conditions were declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall affect only that provision or the part of it that is null or ineffective, the General Conditions remaining in force in all other respects, the provision or the part of it that was affected being deemed as not included.
11.- ONLINE DISPUTE RESOLUTION
In accordance with article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free-access platform for the online resolution of disputes between the USER and the PROVIDER, without the need to resort to the courts of justice, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the dispute. 12.- APPLICABLE LAW AND JURISDICTION
These conditions shall be governed or interpreted in accordance with Spanish legislation in matters not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the services covered by these Conditions to the Courts and Tribunals of the user's domicile (if considered a consumer for the purposes of the TRLGDCU).
13.- APPLICABLE REGULATIONS
These General Conditions are subject to the provisions of: European regulations governing electronic commerce:
- Directive 97/7/EC on the protection of consumers in respect of distance contracts (Distance Selling Directive).
- Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce in the internal market (Directive on electronic commerce).
- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation). Spanish regulations:
- Law 3/2014, of 27 March, amending the consolidated text of the General Law for the Defence of Consumers and Users.
- Law 7/1998, of 13 April, on general terms and conditions of contract, and subsequent amendments.
- Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.
